PorchFox Terms & Conditions

1. Introduction

PorchFox is an online marketplace operated by Veteran United LLC, a veteran-owned business based in Virginia, United States.

These Terms & Conditions govern your access to and use of the PorchFox website, mobile applications, and related services (collectively, the “Platform”).

By accessing or using PorchFox, you agree to these Terms & Conditions. If you do not agree, please do not use the Platform.

2. Definitions

PorchFox / Platform: The online marketplace operated by Veteran United LLC.

Customer: An individual or business that posts a Need or requests services through PorchFox.

Tasker: An independent service provider who offers to perform services requested by Customers.

Need: A description of a task, service, or other assistance requested by a Customer.

Offer: A proposal submitted by a Tasker describing the proposed service, price, schedule, or other conditions.

3. Customer Responsibilities

Customers agree to:

Provide accurate account and contact information.

Describe their Needs clearly and honestly.

Set a reasonable budget and communicate relevant requirements.

Review Tasker profiles, Offers, prices, and proposed conditions before accepting an Offer.

Provide accurate information about the location, scope, and nature of the requested work.

Treat Taskers respectfully and provide a reasonably safe working environment.

Pay agreed amounts and applicable fees disclosed before payment.

Comply with applicable laws and refrain from fraudulent, abusive, discriminatory, or unlawful conduct.

Customers must have the authority to request work at the relevant property or location.

4. Tasker Responsibilities

Taskers agree to:

Provide accurate profile details, service descriptions, qualifications, and pricing.

Submit honest Offers that reflect the proposed scope of work and applicable conditions.

Perform accepted work professionally, safely, and in accordance with the agreed terms.

Communicate promptly about scheduling, delays, cancellations, and changes to the requested work.

Obtain and maintain all licenses, permits, certifications, and insurance required for their services.

Comply with applicable laws, regulations, and relevant safety standards.

Respect Customer privacy and protect personal information obtained through the Platform.

Avoid fraudulent activity, misleading claims, harassment, and unlawful conduct.

Taskers are responsible for determining whether they are qualified and legally authorized to perform the requested work.

5. Independent Contractor Relationship

Taskers are independent service providers and are not employees, agents, partners, or joint-venture participants of PorchFox or Veteran United LLC solely because they use the Platform.

Taskers generally determine how to perform accepted work, subject to applicable law and the agreement reached with the Customer.

Taskers are responsible for their own taxes, business expenses, equipment, licenses, insurance, and other legal obligations associated with their services.

PorchFox provides a marketplace intended to connect Customers with independent Taskers. Unless expressly agreed otherwise in writing, PorchFox does not directly employ Taskers or guarantee their availability, qualifications, work quality, or performance.

Nothing in these Terms overrides any employment or other legal relationship that may arise under applicable law based on the actual circumstances.

6. Posting Needs and Submitting Offers

Customers may post Needs describing the services or assistance they require. Needs must be accurate, lawful, and sufficiently detailed to help Taskers understand the requested work.

Taskers may review available Needs and submit Offers. Offers may include proposed pricing, scope of work, estimated completion time, materials, scheduling, and other relevant conditions.

Customers may review Offers and select the Tasker they prefer. Posting a Need does not guarantee that an Offer will be received or that a service will be provided.

Customers and Taskers should confirm the agreed scope, price, schedule, and important conditions before work begins.

Any material change to the requested work or agreed price must be communicated and approved by both parties before proceeding with the additional work.

PorchFox may remove or restrict Needs or Offers that violate these Terms, applicable law, or relevant Platform policies.

7. Customer Budgets and Pricing

Customers may specify a budget or estimated spending range when posting a Need. A stated budget is an indication of the Customer's intended spending and is not necessarily a binding price agreement.

Taskers may submit their own proposed prices through Offers. Customers should review the full price, included services, additional expenses, and applicable Platform fees before accepting an Offer.

The final agreed price should be confirmed by both parties before work begins. Additional work, materials, travel, or other expenses should not be charged without the required agreement.

Any change to the agreed price must be communicated clearly and accepted by the relevant parties before the additional charges are incurred.

8. Payments and Platform Fees

Users must follow the payment procedures supported by PorchFox for applicable transactions.

Where payments are processed through the Platform, transactions may be handled by third-party payment providers and may be subject to their terms, verification procedures, and processing requirements.

Applicable Platform fees, service charges, payment processing fees, and other charges will be disclosed before the relevant payment is completed, as required by law.

Customers are responsible for paying agreed amounts properly due for services. Taskers are responsible for applicable fees or deductions disclosed to them before the relevant transaction.

PorchFox does not guarantee uninterrupted payment processing or the availability of every payment method.

Users must not engage in payment fraud, submit false payment information, or misuse transaction, cancellation, or refund procedures.

9. Cancellations and Refunds

Customers and Taskers should communicate promptly if a service needs to be cancelled, rescheduled, or changed.

Cancellation eligibility, applicable charges, and refund amounts depend on the agreed service terms, the circumstances of the cancellation, applicable Platform policies, and applicable law.

Where PorchFox processes or facilitates a payment, users may contact support@contactporchfox.com for assistance with payment or refund requests.

Refund requests may be reviewed using relevant transaction information and the applicable terms. A refund is not automatically guaranteed solely because a service is cancelled or a Customer is dissatisfied.

Nothing in this section limits any refund rights or other protections that cannot legally be excluded.

10. Licensing, Permits, and Insurance

Taskers are responsible for identifying and obtaining all licenses, registrations, permits, certifications, and insurance required for the services they provide.

Taskers must not accept or perform work for which they lack legally required qualifications or authorization.

Taskers should maintain insurance required by law or applicable to the nature of their services and should accurately disclose relevant qualifications when requested.

Customers should independently verify licenses, insurance, references, and qualifications when appropriate for the requested work.

PorchFox does not guarantee that a Tasker holds a particular license, certification, or insurance policy unless PorchFox expressly verifies and represents that information.

11. Safety and Prohibited Conduct

All users must use PorchFox lawfully and respectfully.

Users must not:

Engage in fraud, threats, harassment, violence, or unlawful discrimination.

Request or perform unlawful, dangerous, or prohibited activities.

Misuse personal information or attempt unauthorized access to accounts or systems.

Post misleading Needs, fraudulent Offers, or false profile information.

Interfere with Platform security or misuse payment and dispute procedures.

Use the Platform to violate another person's rights or applicable law.

Customers and Taskers should take reasonable precautions when arranging meetings or performing services. Users should not proceed with work if they reasonably believe the circumstances are unsafe or unlawful.

Suspected fraud, safety concerns, and violations may be reported to support@contactporchfox.com. In an emergency, users should contact the appropriate emergency services.

12. Disputes Between Customers and Taskers

Customers and Taskers should first attempt to resolve service-related disagreements through clear and respectful communication.

PorchFox may, at its discretion and subject to applicable law, review reports, request supporting information, facilitate communication, or take action under these Terms.

PorchFox does not guarantee that every dispute can be resolved or that any particular outcome will be achieved.

Customers and Taskers remain responsible for their respective agreements and obligations. Nothing in these Terms prevents users from pursuing legal rights or remedies available under applicable law.

13. Platform Availability and Limitation of Liability

PorchFox will make reasonable efforts to maintain the Platform but does not guarantee uninterrupted, secure, or error-free access at all times.

To the extent permitted by applicable law, PorchFox is not responsible for the independent acts, omissions, representations, qualifications, or performance of Customers or Taskers, or for the quality or outcome of services arranged between them.

To the extent legally permitted, PorchFox will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of the Platform.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.

The scope of PorchFox's responsibilities for payments, refunds, verification, and other services depends on the services actually provided, applicable agreements, and applicable law.

14. Account Suspension and Termination

Users may stop using PorchFox and may request account closure through available account settings or by contacting support@contactporchfox.com.

PorchFox may investigate suspected violations and restrict, suspend, or terminate accounts where reasonably necessary to address fraud, unlawful activity, security risks, violations of these Terms, or risks to users or the Platform.

Where appropriate and legally permitted, PorchFox may provide notice and an opportunity to address the issue. Immediate restrictions may be necessary to protect users, transactions, information, or Platform security.

Account suspension or termination does not eliminate outstanding payment obligations or provisions that are intended to continue after termination.

Information associated with closed accounts will be retained or deleted in accordance with the Privacy Policy and applicable law.

15. Privacy and Data Protection

PorchFox's collection, use, storage, and disclosure of personal information are described in the PorchFox Privacy Policy.

Users should review the Privacy Policy to understand how account information, location data, payment-related information, and information shared with third-party service providers may be handled.

Users must provide accurate information and must not share another person's personal information unlawfully.

Privacy-related questions and requests may be directed to support@contactporchfox.com.

16. Changes to These Terms

PorchFox may update these Terms to reflect changes to its services, policies, business operations, or legal obligations.

Updated Terms will be published on the Platform with a revised effective date. Where required by law, PorchFox will provide notice of material changes or obtain any necessary consent.

Your continued use of PorchFox after revised Terms take effect will be subject to applicable law and any required acceptance procedures.

17. Governing Law

These Terms are intended to be governed by the laws of the Commonwealth of Virginia, without regard to its conflict-of-law principles, to the extent permitted by applicable law.

Any legal proceedings will be brought before a court with appropriate jurisdiction, subject to applicable consumer protection laws and mandatory venue requirements.

Nothing in these Terms removes rights or protections that applicable law requires to remain available to users.
